2. Applicability

These terms and conditions apply to all offers, orders, and agreements made through the Haaksels en breisels webshop, unless otherwise agreed in writing.

Before placing an order, the customer can view and save these terms and conditions.

3. Products

Haaksels en breisels sells, among other things:

• digital crochet and knitting patterns, such as PDF files;

• physical handmade products;

• crochet and knitting kits.

The key characteristics of each product are indicated as clearly as possible.

Digital products are delivered via a download and/or by email. Physical products and kits are shipped by post or another delivery method offered.

4. Prices and payment

All stated prices are in euros and include VAT, unless otherwise indicated for the product.

Any additional costs, such as shipping costs, are clearly stated before the order is finalized.

The order must be paid using a payment method offered in the webshop. For digital products, the product is delivered after payment has been successfully received.

5. Delivery

Digital products

After successful payment, the customer gets access to the digital product via a download and/or email.

If the email is not received right away, it's recommended to also check the spam or junk mail folder.

Physical products and kits

Physical products and crochet and knitting kits are shipped as quickly as possible and within the timeframe stated for the product or otherwise agreed.

If no specific delivery time has been agreed, the order will be delivered within 30 days at the latest, unless otherwise agreed in writing.

If an order is delayed or cannot be delivered, the customer will be informed of this as soon as possible.

5a. Shipping costs

No shipping costs are charged for digital products.

Shipping costs may be charged for physical products, custom-made items, and crochet and knitting kits.

The amount of the shipping costs is clearly stated before the order is finalized.

Any additional costs for delivery abroad are clearly stated in advance.

6. Right of withdrawal

Digital products

For digital content not supplied on a physical medium, a statutory cooling-off period applies in principle.

If the customer chooses to receive the digital product immediately, the customer must explicitly agree to immediate delivery before delivery takes place, and acknowledge that the right of withdrawal is lost as a result.

Once these conditions have been met, the customer can no longer withdraw from the purchase of the relevant digital product after delivery.

Physical products and kits

For physical products and crochet and knitting kits, the statutory right of withdrawal of 14 days applies, unless a statutory exception applies.

The cooling-off period starts on the day after the customer, or a third party designated by the customer who is not the carrier, has received the product.

The customer does not need to give a reason for exercising the right of withdrawal.

After reporting the withdrawal, the customer has another 14 days to return the product.

The costs of returning a product are borne by the customer, unless otherwise agreed.

Exception for custom-made items

The right of withdrawal does not apply to products that are made to the customer's specifications or that are clearly personal in nature.

If a product falls under this exception, this is clearly stated before the order is placed.

7. Copyright and use of patterns

All crochet and knitting patterns from Haaksels en breisels are protected by copyright.

Permitted

The customer may use the purchased pattern for personal use.

It is permitted to make physical finished products using a pattern from Haaksels en breisels and to sell these in limited quantities, provided the following is clearly stated:

Design by Haaksels en breisels.

Not permitted

Without prior written permission, it is not permitted to:

• copy patterns;

• distribute patterns digitally or on paper;

• resell patterns;

• make patterns public or publish them online;

• offer patterns as part of workshops, courses, or other paid activities;

• incorporate patterns into bundles or other publications.

Purchasing a pattern does not grant ownership of the pattern or the associated copyrights.

8. Product information and liability

Haaksels en breisels compiles product information and patterns as carefully as possible. Despite this care, it may happen that a pattern contains an imperfection or error.

If a customer discovers an error or ambiguity in a pattern, the customer can get in touch via the stated email address. Haaksels en breisels will try to resolve the issue as quickly as possible.

The consumer's statutory rights always remain applicable. These terms and conditions do not limit these statutory rights.

Haaksels en breisels is not liable for damage resulting from use of a product in a way that could not reasonably have been foreseen or that is contrary to the instructions provided with the product, to the extent permitted by law.

9. Complaints and statutory warranty

Complaints about an order or product can be reported as soon as possible via haakselsenbreisels@gmail.com. Please include the order number, if possible, and a clear description of the complaint.

Haaksels en breisels tries to resolve complaints as quickly as possible and in consultation with the customer.

The consumer's statutory rights, including the right to a product that conforms to the agreement, remain applicable.

If a physical product does not conform to the agreement, the consumer is entitled to an appropriate solution, such as repair, replacement, or – if the statutory conditions are met – a refund.

10. Privacy

Personal data is processed in accordance with applicable privacy legislation.

Personal data is used for, among other things, processing and delivering orders, maintaining customer contact, and handling questions and complaints.

11. Applicable law

Dutch law applies to agreements between Haaksels en breisels and consumers to which these terms and conditions relate.

This does not affect the statutory rights of consumers under mandatory consumer law.
